1. ACCEPTANCE OF TERMS By downloading, accessing, or using the "Rise: Morning App Blocker" mobile application, formerly "Rise: Morning Routine" (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a binding legal agreement between you and Rise: Morning App Blocker ("we," "us," or "our").

2. DESCRIPTION OF SERVICE Rise: Morning App Blocker is a productivity application designed to help users wake up by restricting access to specific applications on their device until certain tasks are completed.

  • Functionality: The App utilizes Apple’s Screen Time API to restrict access to selected apps (e.g., social media) until the user completes a "Morning Routine."
  • Unlocking Mechanisms: To lift the restrictions, the user must either:
    1. Walk a specific number of steps (verified via Apple HealthKit); or
    2. Take a photograph of a specific object (verified via OpenAI image recognition).
  • Paid Service: Rise is offered as an auto-renewing subscription, with a free trial for eligible customers. Section 4 sets out pricing, renewal, and cancellation.

3. MEDICAL AND HEALTH DISCLAIMER Rise: Morning App Blocker is not a medical device or a healthcare provider.

  • No Medical Advice: The App is intended for productivity and lifestyle motivation only. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
  • Physical Activity: The App encourages physical activity (e.g., walking 100 steps). You should consult with a healthcare professional before starting any new fitness routine. By using the App, you represent that you are in good physical condition and have no medical reason or impairment that might prevent you from using the App as intended.
  • No Guarantee of Results: While our marketing materials may suggest that the App can "improve your life" or "build better habits," these are aspirational statements. We make no guarantees regarding specific outcomes, productivity levels, or lifestyle improvements. Individual results will vary.

4. SUBSCRIPTIONS, PRICING, AND CANCELLATION

  • Subscription Plans: Rise offers monthly and annual auto-renewing subscriptions. Your App Store storefront determines the available prices, currency, and offers. The selected billing period and the total charge are shown before you confirm a purchase.
  • Free Trial: A free introductory trial is available only to eligible customers. Its duration and the subsequent subscription price are displayed at checkout. Previous use of a trial may affect your eligibility.
  • Billing and Renewal: Payment is charged to your Apple Account. At the end of an eligible trial, the selected subscription renews at its displayed regular price unless cancelled. Subscriptions renew automatically.
  • Cancellation: To avoid the next charge, cancel at least 24 hours before renewal in your App Store subscription settings. Cancellation stops future renewal, and your access continues until the current entitlement expires. Optional reminder notifications are a convenience and do not cancel a subscription.
  • Managing Your Subscription: Manage Subscription in Rise provides cancellation, restoration, help, and refund request routes.
  • Refunds: Apple reviews and decides refund requests. Submitting a request does not guarantee a refund. You can also request a refund through Apple's Report a Problem service.
  • Deleting the App: Deleting Rise, or deleting its local data from within the App, does not cancel a subscription. When a subscription expires, Rise releases its app-blocking restrictions.
  • No Account Required: The App does not require you to create an account. Your purchase is associated with your Apple Account.
  • Changes to Pricing or Plans: We may change subscription pricing, plans, or trial eligibility. Any such change applies only on a forward-looking basis, is disclosed before it takes effect, and any price increase affecting an existing subscription is subject to Apple's notice and consent requirements.
  • No Guarantee of Continued Availability: We provide the App on an "as is" and "as available" basis and may modify, suspend, or discontinue the App or any feature at any time. If we discontinue the App, you may seek a refund for any unused portion of a prepaid period through Apple.

5. DATA PERMISSIONS AND THIRD-PARTY SERVICES To function correctly, the App requires access to specific features on your device and utilizes third-party services.

  • Apple HealthKit: You grant the App permission to read step count data from Apple Health to verify movement. This data is used solely for the functionality of the alarm/unlock feature.
  • Screen Time API: You grant the App permission to restrict access to other applications on your device. You acknowledge that while the App is active, you may be unable to access these restricted apps until the unlock criteria are met.
  • OpenAI (Image Recognition):
    • When you use the photo unlock feature, the image you take is transmitted to OpenAI (a third-party service provider) for analysis.
    • Data Processing: By using this feature, you consent to the transmission of your image data to OpenAI.
    • Retention: While "Rise: Morning App Blocker" does not permanently store these photos on our own servers, they are processed by OpenAI. We encourage you to review OpenAI’s Usage Policies regarding data retention.
    • Accuracy: We do not guarantee the accuracy of the image recognition software.
  • Apple (App Store Billing): Subscriptions are sold and billed by Apple. Apple processes your payment and reviews refund requests under its own terms. We do not receive your payment-card details.
  • RevenueCat: We use RevenueCat, Inc. to verify your purchase status and to provide purchase restoration and subscription support. RevenueCat processes a generated app-user identifier and purchase information such as product, transaction identifier, billing period, store, and subscription status, as described in our Privacy Policy.
  • Google Analytics for Firebase and Google Ads (Optional): App usage analytics and advertising measurement are optional and only occur if you allow them in the App. Advertising measurement additionally requires your authorization of Apple's App Tracking Transparency prompt. Advertising personalization is disabled in this implementation. You can change your choice at any time under Manage Subscription. The App functions normally if you decline. Data collection, processing, and your choices are described in our Privacy Policy.
  • Facebook SDK (Meta Platforms, Inc.):
    • The Facebook SDK for iOS remains bundled in the App and its privacy manifest is included in our build. Automatic Facebook app-event logging and advertiser-identifier collection are disabled in this release, and we do not send subscription reporting to Meta. If we re-enable these in a future release, we will update these Terms and our Privacy Policy first.
    • Your Agreement: To the extent the integration is active, you agree to Facebook's Terms of Service, Platform Policies, and applicable Advertising Guidelines, and Meta will use any information it receives in accordance with their Data Use Policy.
    • Data Disclosure (iOS 14+): Consistent with Apple's App Store data disclosure requirements, the data types collected by the App are disclosed in our App Store privacy nutrition label. It is your responsibility to review these disclosures before downloading the App.

6. USER CONDUCT You agree not to:

  • Use the App for any illegal purpose.
  • Attempt to bypass the Screen Time restrictions through hacking or technical exploits.
  • Upload photos that are illegal, offensive, pornographic, or infringe upon the rights of others when using the image recognition feature.

7. INTELLECTUAL PROPERTY All rights, title, and interest in and to the App (excluding content provided by users) are and will remain the exclusive property of Rise: Morning App Blocker and its licensors.

8. LIMITATION OF LIABILITY To the maximum extent permitted by law, in no event shall Rise: Morning App Blocker be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the App.
  • Any failure of the App to restrict or unrestrict applications as intended (e.g., if a bug prevents you from accessing your phone during an emergency). You acknowledge that you should retain the ability to make emergency calls at all times.
  • The conduct of any third party (including OpenAI or Apple).

9. APPLE-SPECIFIC TERMS Since this App is downloaded from the Apple App Store, you acknowledge that:

  • These Terms are between you and us, not Apple.
  • Apple has no obligation to furnish any maintenance and support services with respect to the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. Subscription refund requests are handled by Apple as described in Section 4.
  • Apple EULA: Your use of the App is also subject to the Apple Licensed Application End User License Agreement (EULA). In the event of a conflict between these Terms and the Apple EULA, these Terms shall govern.

10. GOVERNING LAW These Terms shall be governed and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.
