1. ACCEPTANCE OF TERMS By downloading, accessing, or using the "Rise: Morning Routine" mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a binding legal agreement between you and Rise: Morning Routine ("we," "us," or "our").

2. DESCRIPTION OF SERVICE Rise: Morning Routine is a productivity application designed to help users wake up by restricting access to specific applications on their device until certain tasks are completed.

  • Functionality: The App utilizes Apple’s Screen Time API to restrict access to selected apps (e.g., social media) until the user completes a "Morning Routine."
  • Unlocking Mechanisms: To lift the restrictions, the user must either:
    1. Walk a specific number of steps (verified via Apple HealthKit); or
    2. Take a photograph of a specific object (verified via OpenAI image recognition).

3. MEDICAL AND HEALTH DISCLAIMER Rise: Morning Routine is not a medical device or a healthcare provider.

  • No Medical Advice: The App is intended for productivity and lifestyle motivation only. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
  • Physical Activity: The App encourages physical activity (e.g., walking 100 steps). You should consult with a healthcare professional before starting any new fitness routine. By using the App, you represent that you are in good physical condition and have no medical reason or impairment that might prevent you from using the App as intended.
  • No Guarantee of Results: While our marketing materials may suggest that the App can "improve your life" or "build better habits," these are aspirational statements. We make no guarantees regarding specific outcomes, productivity levels, or lifestyle improvements. Individual results will vary.

4. SUBSCRIPTIONS AND BILLING

  • Annual Plan: The App allows access to premium features through a yearly auto-renewing subscription.
  • Free Trial: We offer a 7-day free trial. YOU MUST CANCEL THE SUBSCRIPTION AT LEAST 24 HOURS BEFORE THE END OF THE TRIAL PERIOD TO AVOID BEING CHARGED.
  • Billing and Renewal: If you do not cancel before the trial ends, the full price of the yearly subscription will be charged to your Apple ID account. The subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
  • No Refunds: Subscriptions are managed directly by Apple. We do not have the ability to process refunds. Refund requests must be made directly to Apple Support.
  • Price Changes: We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion.

5. DATA PERMISSIONS AND THIRD-PARTY SERVICES To function correctly, the App requires access to specific features on your device and utilizes third-party services.

  • Apple HealthKit: You grant the App permission to read step count data from Apple Health to verify movement. This data is used solely for the functionality of the alarm/unlock feature.
  • Screen Time API: You grant the App permission to restrict access to other applications on your device. You acknowledge that while the App is active, you may be unable to access these restricted apps until the unlock criteria are met.
  • OpenAI (Image Recognition):
    • When you use the photo unlock feature, the image you take is transmitted to OpenAI (a third-party service provider) for analysis.
    • Data Processing: By using this feature, you consent to the transmission of your image data to OpenAI.
    • Retention: While "Rise: Morning Routine" does not permanently store these photos on our own servers, they are processed by OpenAI. We encourage you to review OpenAI’s Usage Policies regarding data retention.
    • Accuracy: We do not guarantee the accuracy of the image recognition software.

6. USER CONDUCT You agree not to:

  • Use the App for any illegal purpose.
  • Attempt to bypass the Screen Time restrictions through hacking or technical exploits.
  • Upload photos that are illegal, offensive, pornographic, or infringe upon the rights of others when using the image recognition feature.

7. INTELLECTUAL PROPERTY All rights, title, and interest in and to the App (excluding content provided by users) are and will remain the exclusive property of Rise: Morning Routine and its licensors.

8. LIMITATION OF LIABILITY To the maximum extent permitted by law, in no event shall Rise: Morning Routine be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the App.
  • Any failure of the App to restrict or unrestrict applications as intended (e.g., if a bug prevents you from accessing your phone during an emergency). You acknowledge that you should retain the ability to make emergency calls at all times.
  • The conduct of any third party (including OpenAI or Apple).

9. APPLE-SPECIFIC TERMS Since this App is downloaded from the Apple App Store, you acknowledge that:

  • These Terms are between you and us, not Apple.
  • Apple has no obligation to furnish any maintenance and support services with respect to the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you.
  • Apple EULA: Your use of the App is also subject to the Apple Licensed Application End User License Agreement (EULA). In the event of a conflict between these Terms and the Apple EULA, these Terms shall govern.

10. GOVERNING LAW These Terms shall be governed and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.
